Insurance Companies Downplay Your Injuries, but Neck & Back Injuries Can Be Debilitating For Life

Insurance Companies save money by labeling people.  For example, if their insured rear ends your vehicle on the road, and you go to the doctor and are diagnosed with a muscle strain in your neck or lower back, they label it a “soft tissue” injury, not worthy of medical care.  If your car was damaged but not declared a total loss, they label the collision a “minor impact.”  They do not care what pain you are in, what medical treatment helps you get back to your daily life, or whether or not you have suffered lost wages.  They just repeat “minor impact, soft tissue” as a justification for not taking accountability for the damages their insured has caused you.  They even have an acronym for these cases, “MISTI,” or Minor Impact Soft Tissue Injury.

Insurance companies will repeat these labels all the way to a jury trial. The insurance company will hire a lawyer to repeat the labels to an unsuspecting jury, and they will hire dubious medical experts to repeat the labels under the guise of “objective testimony.”  All of this is done to simply save insurance companies money.

Unfortunately for these insurance companies, their lawyers, and their deceptive experts, the medical community has determined that soft tissue injuries due to automobile collisions, even with minor property damage, can result in life long disability.

Some recent articles in 2008 and 2009 studied the injuries associated with the term “whiplash” used in the motor vehicle collision context, and the long term ramifications of such injuries.   The studies state: According to an extensive review of whiplash injury, the structures most likely to be injured in whiplash were the facet capsule, the intervertebral discs and the upper cervical ligaments. It was estimated that the annual incidence was 3.8 per thousand populations in the US. A proportion of victims will be left with a significant disability that may interfere with jobs, everyday activities, and leisure-time pursuits. Most studies on the natural history of whiplash injuries have suggested a proportion between 6% and 18% with long-term disability.”
