We Help You Protect Your Rights If You Are Injured By A Distracted Driver

According to the National Highway Traffic Safety Administration, taking your eyes of the road for even five seconds while driving at 55 miles per hour is the same as driving the entire length of a football field while wearing a blindfold!  If everyone knew how dangerous it really is to drive while distracted, no one would do it.  Unfortunately, many people do not understand the risk distracted driving creates until it is too late.

Texting while driving and other cellphone use behind the wheel is extremely dangerous and puts everyone’s life at risk. On January 1, 2015, the City of Austin City Council passed Ordinance No. 20140828-041, which prohibits the use of portable devices while moving in a car or on a bike.  The Austin Hands-Free Ordinance defines portable electronic devices as the following:

Portable electronic device means a hand-held, mobile telephone, personal digital assistant, MP3 or other hand-held music player, electronic reading device, laptop computer, pager, broadband personal communication device, GPS or navigation system, electronic gaming device or portable computing device.

Hand held cell phone use is permitted in the event of an emergency such calling 9-1-1 or 3-1-1 to report a crime or an accident. Even in an emergency situation, it is best to pull over to a safe place and come to a complete stop before using or operating any mobile or hand held device.

Austin Distracted Driving Accidents Can Be Complex—You Need an Experienced Lawyer

Cellphone use and other careless behaviors while driving increase the chances of a car accident. Law enforcement authorities in Texas and nationwide are on the lookout for distracted drivers, yet it can be difficult to prove that a driver was not paying attention. We have the resources and experience to secure a reckless driver’s cell phone records to prove that they were not paying attention at the time of the collision.

Austin Distracted Driving Safety Tips

We care about your safety and urge you to put your cellphone down and reduce other distractions when driving to protect yourself and everyone on the road.  Men, put your cell phone in your pocket before you get in the car.  Ladies, put your cell phone in your purse, and place your purse in the backseat.

Imagine waking up one morning. Everything goes as it usually does. You walk to your car for your drive to work. You get in, fasten your seat belt, and are on your way. The next thing you know, you are waking up in a hospital, unable to feel or move your arms and legs
It has been reported by AAA Foundation for Safety that teen driving accidents increase significantly from June 1st – Labor Day. Events such as graduation and summer break festivities all play a factor in the number of teen car accidents, but statistics indicate that distracted driving and more teenagers in the car at one time are the primary cause of these accidents.
Government researchers recently conducted a study to analyze and compare the use of cell phones while driving by teenagers and adults. The sample of teens performed remarkably well using the cell phone while driving: they were able to dial numbers, answer the phone, send emails and texts, and even browse the internet. Unfortunately, they blew through 30 percent of the stop signs on the closed course.
