Fatal Pedestrian Accidents in Austin

March 20, 2018

Pedestrian accidents are not uncommon. The weight, speed, and force of a vehicle hitting a person can be intense. And, it often results in serious injuries or loss of life. The statistics are alarming. In 2015, the National Highway Traffic Safety Administration says 5,376 pedestrians were killed in accidents involving vehicles. That year, there were 476 such incidents in Texas alone. Texas, ranks third, behind California and Florida, in the number of pedestrian/vehicle fatalities.

Here in Austin, the risks are high. Individuals who head out for a walk after dinner or perhaps to a local park for a walk with the kids should never feel as though they are unsafe. Yet, this is very commonly the case.  There have been numerous instances of pedestrian accidents throughout the city including those that occur during normal daylight hours. They can happen to anyone, though many times children are involved. Unfortunately, many times pedestrian accidents like this lead to fatalities. In Austin, we face countless areas of high risk. As a pedestrian, you should not have to worry about where you decide to go for a walk. But, right now, you may.  Austin roads are dangerous not just for cars, but for pedestrians, too.

The Cagle Law Firm provides outstanding support and experience to victims who have suffered serious injury from such incidents. We encourage you never to wait or settle with an insurance company for injuries sustained in an Austin pedestrian/vehicle accident until you speak to an attorney.

Where do pedestrian accidents occur in Austin? They can – and do – happen everywhere. There are some that occur in residential areas, such as when individuals are walking on their neighborhood streets. Others have occurred in the Barton Creek Greenbelt area, especially near Sunset Valley. For those pedestrians injured while they are simply looking to enjoy the beautiful greenbelts Austin has to offer, this can be devastating.

Many of these accidents also occur along I-35 and the frontage road in Austin. This includes many intersections along that route. However, in the densely populated downtown area, the risks rise. From East Cesar Chavez Street through East 12th Street in Austin, several fatal accidents have occurred. It makes sense since more people walk the downtown area to get around. But, going out on your lunch break should never put you at risk.

Another hot spot for pedestrian accidents occurs a bit more towards the north along US 183. East Anderson Lane has had numerous fatalities as well. This includes near Loyola Lane and Springdale Road.

For those who have traveled Loop 275, or North Lamar Blvd, you know that this area has heavy traffic. This, of course, puts those walking at risk. And, this includes the area of South Congress Avenue.

Yet another area of concern is along East Riverside Drive. This area, where there are a number of parks and smaller neighborhoods is a high risk are for fatal pedestrian/vehicle collisions.

There are many reasons why this occurs. In nearly all cases, the pedestrian is not at fault. Most of the time, pedestrians have the right of way. That means drivers must stop and allow a person walking to pass by before moving forward, turning, or backing up. Sometimes, this occurs due to a lack of paying attention. Distracted drivers – such as those who may be using their cell phone or those who are paying attention to the radio – may be more likely to cause such accidents. Those who are driving under the influence of alcohol or drugs are also a high risk concern. In other cases, they can happen due to a driver’s lack of skill behind the wheel.

No matter why they happen, any driver who hits a pedestrian is likely to face legal charges. In addition to this, that driver’s liability insurance should provide financial compensation for the pedestrian’s losses that result from an injury. This may include losses related to medical bills, long term care and rehabilitation, pain and suffering, lost time at work, and more. Many times, these types of accidents are fatal. When this occurs, there is an incredible loss suffered by the family.

Pedestrians should take action as soon as possible to document their case. If you are hit by a car, gather as much information as possible, if it is safe to do so. You should always get help from a medical provider – visit the local emergency room. Then, contact your personal injury attorney in Austin. Our team will work closely with you to ensure that all of your losses are accounted for so you can seek comprehensive compensation for your losses.

Do not settle your claim with the insurance company. And, do not feel rushed to do so.
